Can I continue working on STEM OPT while my H-1B petition is pending?
I am currently on a STEM OPT extension, and my employer has recently filed an H-1B petition on my behalf. While the H-1B petition is pending and awaiting approval, am I legally allowed to continue working for my employer? Specifically, I would like to know: Does the filing of the H-1B petition impact my current STEM OPT work authorization in any way? What happens if my current STEM OPT EAD expires while the H-1B petition is still pending? Does the "Cap-Gap" extension automatically apply to STEM OPT individuals to allow continuous employment until October 1st?
